Agreement
By using nixvora.com or a Nixvora app, you agree to these terms and to our privacy policy. If you don’t agree, please don’t use them. Client projects for the studio or Flyntex are covered by a separate written agreement.
Using our apps
We give you a personal, non-exclusive, non-transferable license to use our apps on devices you own or control, for non-commercial use. Apps downloaded from the App Store are also licensed under Apple’s Standard Licensed Application End User License Agreement; apps from Google Play are also subject to Google Play’s terms. Where those terms conflict with these, the store’s terms apply to the extent of the conflict. Apple and Google are not responsible for our apps or for supporting them.
We may update, change or discontinue features, and we may need you to install updates to keep using an app.
Children and parents
Our educational apps are designed for children to use with a parent or caregiver nearby. Parent features, such as the Montessori Guide, are intended for adults. By setting up an app for a child, you confirm that you are their parent or guardian or have their permission.
The Montessori Guide
The Guide uses an artificial intelligence model to generate answers. Answers are general educational information. They may be incomplete or wrong and are not medical, psychological, developmental, legal or other professional advice. Talk to a qualified professional about any concern regarding a child’s health or development. Don’t enter sensitive personal information into the Guide, and don’t use it to create anything unlawful or harmful.
Acceptable use
Please don’t misuse our website, apps or servers. That includes trying to access them in ways we haven’t provided, interfering with their security or availability, reverse engineering them except where the law allows, scraping them in bulk, or using them to break the law.
Intellectual property
The apps, this website and their content, including the Nixvora, Terra Montessori and Flyntex names and logos and the Sprout character, belong to Nixvora or our licensors. Montessori is a widely used educational method; our apps are not affiliated with or endorsed by any Montessori organization. Assets in our press kit may be used to write about our apps.
Third-party services
Some features rely on other companies, such as AI answers from Anthropic or speech from your device’s operating system. Links to other websites are provided for convenience; we aren’t responsible for their content.
Disclaimers
We work hard to make our apps and website reliable, but they are provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. Nothing in these terms limits rights you have under consumer protection laws that can’t be excluded.
Limitation of liability
To the extent the law allows, Nixvora won’t be liable for indirect, incidental, special or consequential damages, or for loss of data or profits, arising from your use of our website or apps. Our total liability for any claim is limited to the greater of the amount you paid us for the app in the previous 12 months or US$50.
Governing law
These terms are governed by the laws of the jurisdiction in which Nixvora is registered, without regard to conflict-of-law rules, unless the law where you live requires otherwise.
Changes
We may update these terms. We will change the effective date above and, for significant changes, tell you in the app or on this website before they take effect.
